When Things Go Wrong

There may come a time when homebuyers discover something wrong
with their house, and may be upset or disappointed with the home
inspection.

Some say home inspectors are inconsistent because their reports
identify some minor problems but not others. The minor details
that are identified were probably discovered while looking for
more significant items, and were noted simply as a courtesy. The
intent of the inspection is not to find the $100 detail… it is
to find the $1000 items. Some problems can only be discovered by
living in a house. For example, some shower stalls leak when
people are in the shower, but do not leak when you simply turn
on the tap. If there are no clues of a past problem, one cannot
presume that the inspector should predict a future problem.

The main source of dissatisfaction often comes from comments
made by contractors, whose opinions may differ from that of the
home inspector. Don’t be surprised when three roofers all say
the roof needs replacement when the home inspector said that,
with some minor repairs, the roof would last a few more years.
While the inspector’s advice might represent the most prudent
thing to do, many contractors are reluctant to undertake
repairs. This is because of the “Last Man In Theory”. The
roofing company fears that if they are the last people to work
on the roof, they will be blamed if the roof leaks, regardless
of whether the leak is their fault or not. They might not want
to do a minor repair with high liability when they could re-roof
the entire house for more money and reduce the likelihood of a
call-back. This is understandable.

There is more to the “Last Man In Theory”. It suggests that it
is human nature for homeowners to believe the last bit of
“expert” advice they receive, even if it is contrary to previous
advice. Home inspectors unfortunately find themselves in the
position of “first man in” and consequently it is their advice
which is often disbelieved.

“I can’t believe you had this house inspected, and they didn’t
find this problem.”

There are several reasons for apparent oversights: 1. Home
inspectors are generalists, not specialists. The heating
contractor may have more heating expertise than the average home
inspector. This is because home inspectors are also expected to
have cooling, plumbing, roofing, structural and electrical
expertise. 2. When a problem manifests itself, it is very easy
to have 20/20 hindsight. Anybody can say that the basement is
wet when there’s 2 inches of water on the floor. Predicting
basement dampness is a different story. 3. If the home inspector
spent half an hour under the kitchen sink or 45 minutes
disassembling the furnace, s/he could find more problems, too…
but the inspection might take a few days, and would cost
considerably more.

Food For Thought:

A home inspection is designed to better one’s odds. It is not
designed to totally eliminate all risk. A home inspection should
not be considered an insurance policy. The premium than an
insurance company would have to charge for a policy with no
deductible, no limit and an indefinite policy period would be
considerably more than the average fee for a home inspection. It
would also not include the value added by the inspection.

What’s best?

Whenever we are about to invest money, whether it be a tin of baked beans, or a complete new hi-fi, we ask ourselves the question what’s best? Where will we get the best value for our money? Where will we get the best return for our investment? Now where we all differ is in what we consider best. For some of us, value is the most important so we go for the lowest price that does the job (covers the toast, or plays CD’s). For others it’s quality so we go for the best we can afford (tastes divine, or makes you feel like you’re standing right next to the band).

These choices seem fairly simple but they are much more complicated than that. They are complicated by things like personal knowledge (what we think we know), personal preferences (style, design, taste), informative advertising (this product does this in this way and it’s new and innovative and better than all the rest).

So we might have to consider what additives, artificial colouring, sweeteners, pesticides are in the beans. We might have to take into consideration branding and choose a reliable name that’s been around awhile, or be modern and innovative and take the heavily advertised newcomer that’s totally healthy, and it’s on the telly so it must be good. Or might know all about the difference between real watts and the sort they mention in advertising when their kit doesn’t have enough of the proper ones. Or about woofers and squeakers or is it tweeters and all that techno stuff that only makes sense if you know the code. But again, apart from the mechanical performance, there’s ’sound’, and branding and advertising and innovation and you probably know an Aiwa won’t sound quite like a Bose kit, or Sanyo the same as Bang & Olufsen. But you might be perfectly happy with any one of those if it sounds good to you and is set at a price where you think you’ve got best value for your money.

So what’s all this got to do with the title of this article?

It’s about making choices when you don’t have enough personal knowledge to buy the best for you. It’s about when you have a problem and you’ve decided you’d like help and you don’t want to waste your money by spending it on something that doesn’t help, or doesn’t help as much as something else would have done. There’s no feeling worse than feeling that you’ve just wasted your money on the wrong thing, because someone with more knowledge comes along later and tells you that you should have bought…

Hypnosis, unless you’ve experienced it at the hands of a good therapist (rather than an entertainer), is a subject most people know very little about. But it’s a subject you’re bound to know someone who thinks they know all about.

For the majority hypnosis is associated with stage shows, after that it helps people to stop smoking and after that it helps people to lose weight and after that they use it in past-life regression and after that there isn’t any after that. But this article isn’t about what hypnosis can and can’t do; it is about the availability of treatment and the format that treatment can take.

In a one-to-one session you get to:
* have personal attention
* ask questions

* have a session that can be changed dynamically depending upon your responses
* effective treatment
* deal with unusual problems that CD’s don’t normally cover
* know that you are safe because you have a professional watching you

with a CD you get to:
* enjoy low-cost treatment
* listen to a session as often as you like
* have much more practice at entering trance (you go deeper the more you do it)
* enjoy treatment at a time and place that suits you
* portable treatment
* effective treatment
* feel safe because you are in a place of your own choosing where you feel secure
* experience hypnosis if you just want to see what it’s like and if it works for you.

Like the beans, or the hi-fi, what’s best is what’s best for you. And what’s best for you depends in part upon what you want. If you want to go and see someone and it’s important for you to have someone listen to your story and give you personal advice and help and guide you step-by-step back to wholeness, and cost isn’t a consideration then a one-to-one with a qualified hypnotherapist is what’s best for you.

If you don’t like talking about your problems; or you feel uncomfortable about the idea of choosing a therapist from Yellow Pages; if cost is a consideration, if the problem you want help with is a problem for which CD’s are readily available then buying a CD and listening to it until you feel better is what’s best for you.

One isn’t better than the other. They are different. Both effective. Both with advantages.

At the end of the day what matters is that you make the right choice for you, even if that’s a CD for weight loss, and a one-to-one for a phobia cure. The right choice for you is the one that makes you feel pleased that you spent the money because you feel good about the results, feel good about the choice you made, and feel good about encouraging others with the same problem to do what you did.

Florida and its New Registered Paralegal Program Implementation

The New Registered Paralegal Program has just been unveiled by Florida. Over 300 have already asked for the application, and a lot more are expected to get it from the Florida Bar’s website.

Be aware that applicants will have to pay an application fee of 150 dollars. In approximately two weeks, approved applicants will receive certificates and welcome packets by mail. A two-tier system for paralegals, a disciplinary system, and a Code of Ethics and Responsibility are set up by the program.

Paralegals with training, education, or work experience who perform delegated, substantive work for lawyers, make up the first tier.

Paralegals in Tier two category are required to fulfill education and work experience requirements, or qualify for a Certificate from the National Association of Legal Assistants (NALA) or the National Federation of Paralegal Associations (NFPA).

In the first three years of this program, paralegals who show substantive experience, but who also lack the educational requirements, can still become Florida Registered Paralegals due to a grand-fathering clause.

The names of people receiving the designation will appear on The Florida Bar Web site.

To retain your credential as a Florida Registered Paralegal, you will need to take 30 hours of continuing education within three years, with five of them in professionalism or ethics.
It is the attorneys who employ or supervise paralegals who have the primary responsibility for monitoring their work. This holds true whether they are Florida Registered Paralegals, or simply Registered Paralegals in other states.

Missed Opportunity - Are my parents to Blame?

Parent’s have undying love for their babies which grows stronger
and stronger each and every day.

The infancy months where four hourly feeds are followed by the
hand aching task of burping baby. Dribbles of milk flow through
your fingers as the infant rests his/her weary scrunched up face
in the palm of your hand fighting off the land of nod. What is
baby thinking? As he/she loses the battle to stay awake.

Then we have the nightmare months of the toddler years where
mum and dad need eyes in the back of their heads. It is at this
time we teach the toddler to walk/talk, and when they do we tell
them to shut up and sit down. It only takes a second for baby to
scale the stairs, and then it is panic stations while you
negotiate and try to convince the child to stay put till you
manage to reach out for them. What a relief when you have them
safe in your arms smothering them with affection while you
chastise them. What is the child thinking? Being loved and
shouted at, at the same time.

We have the first day of school where many a mothers’ heart is
broken leaving their child behind. Some children adapt easily to
their new school and we have the ones that don’t. Thus making it
harder for mummy/daddy to leave as teacher tries coaxing the
screaming child tugging at the apron strings. What is the child
thinking?

Teenage tantrums have to be controlled and the best person for
the job is the parent. We are there to lend a shoulder to cry on
all because they can not have Justin Timberlake or Brittany
Spears on their arm. Then as parents we struggle with Once upon
a time there were the birds and the bees. Parents are the first
to see danger signs. Whether it be the wrong choice in
boy/girlfriend or maybe the people they hang out with. so when
they receive a clip around the ear for doing something they felt
was right and mum and dad didn’t, then what was that child
thinking?

The wedding ring exchange between your child and their partner
tells you the parent it is time to let go now they have all
grown up. But do we ? I don’t think so.

Whatever the age of your kids you will find they will always be
your babies.

What were those children thinking? Well let me tell you, mum and
dad it because they cared.

Want to know what the married kids were thinking? Well I think
you may have guessed that one yourself. So you see as protective
and caring parents we could not let go if we wanted too because
someone has to look after the grandchildren.

It is cruel world out there and in some sad cases children have
lost their parents to illness or misfortunate events and have no
one to point them in the right direction. If you want to help
your kids then further their education. This way they have a
chance to get on in life. An educational background works

Don’t have your kids thinking they missed out on an opportunity
because mum and dad chose not care anymore.
